TERMS OF USE AND LEGAL NOTICE | PULAR2 PROJECT, s.l.
Applicable to the users of the OpiJob web site (hereinafter "OpiJob" or "the Site") starting on May 21, 2008.


1.Objective of this document. Legal Notice.
These terms and conditions regulate the access and use of the site, its contents and the services it makes available to its users, including both clients and the owners business that make up the Site.

It is explicitly established that the regulation, access and use of "the Site"/"OpiJob" be guided in general by the Law 34/2002 of July 11, pertaining to information society services and e-business and specifically by these terms and conditions of service.

2.Acceptance of these terms and conditions.
2.1 Users’ condition.
The fact of access to or use of the Site, or of all or part of the contents and services included in it, qualifies one as a "user" and presupposes full and complete acceptance of these Terms and Conditions and of the Legal Notice, which are displayed on the public version of the site from the users’ first moment of access. This acceptance is implied simply by the act of visiting the Site’s pages, and of course by the use of the services offered on the Site.
The user must declare that he or she is a legal adult and has the legal capacity to take on the obligation imposed by the Terms and Conditions and the Legal Notice herein.

2.2 General Rules for use

The user must use the site conscientiously and properly. The user must communicate respectfully with the other users of the Site. The user takes on the stated obligation not to post any sort of advertising, nor any communications with commercial or advertising intent, nor any other type of unauthorized mass messages.
The user promises to give his or her opinion honestly, respectfully and truthfully based on actual work experiences, always displaying respect for the dignity of others and for the principle of non-discrimination for reasons of race, sex, religion, opinion, nationality, disability or any other personal or social condition.

The user further promises not to make offensive comments about colleagues, superiors, or about the company where he or she currently works or has worked in the past.

In the unlikely event that, despite the enumeration of the above rules, the user fails to comply with any of them and is detected by the OpiJob administrator, said administrator reserves the right to eliminate said comments.

As a consequence of the rules laid out in section 2.2 above, OpiJob is not responsible in case of any possible legal actions undertaken as a result of libel or insults to third parties included in the contributions posted by the user, and will of course facilitate to the proper authorities, were it required to do so, the information it possesses about the user, and the user would be unable to take any action.


2.3 Changes to these Terms and Conditions.

These terms and conditions may be subject to periodical updates and changes. Were this to occur, OpiJob will communicate them to the user, who will then need to submit to and accept the new conditions in order to use the Site.

3. Content and services provided by the Site.
OpiJob is a provider of information that offers, over the Internet, a collection of content and services related to the world of personal experience at the workplace, as well as providing complementary interactive features that are available thanks to the Internet. OpiJob reserves the right to modify, expand or cancel at any time and without prior notice the presentation and configuration of the Site as well as the contents and services included in it.


4. Cookies and other applications.
The user authorizes OpiJob to use cookies. The site uses cookies in order to facilitate use, personalize the information, and analyse the effectiveness and the audience of the web site. If it is the case that you do not wish to receive cookies from OpiJob, we invite you to configure your browser so that it requests your permission before storing a new cookie in your computer.

5.Responsibility for the access and use of OpiJob’s contents and services.
Both access to and use made of the site by the user is the exclusive responsibility of the person carrying it out. For this reason, the user agrees to accept the consequences and any damages that may result from said access or use of the services offered by OpiJob.
OpiJob will do everything within its reach to provide the user with good service through the web page. Nonetheless, OpiJob will not take responsibility for damages or for any of the below:

 

5.1. Availability and continuity.
OpiJob does not guarantee the availability or the continuous functioning of the page and its services at all times.

 

5.2 Truthfulness, precision and updates.
OpiJob does not guarantee the truthfulness or precision of the contents and services of the page, nor that said contents and services are up to date. All information concerning companies and job experience that is offered by the Site to its users is provided only for informational purposes. The information provided by OpiJob has been created based on date facilitated by the Site’s users. OpiJob takes no responsibility for the content, truthfulness, or up-to-date nature of said information.
Users will refrain from posting content that violates the rights of third parties.

 

5.3 Privacy and security.
The user will refrain from producing by any means any form of destruction, alteration, outage of damage to the data, programs or electronic documents belonging to OpiJob or to third parties, as well as from introducing or spreading on the Internet programs, viruses or any other physical or electronic instrument that causes or may cause any type of alternation to the Internet, the system or the computers belonging to OpiJob or to third parties. Carrying out any activity that violates the principles of generally accepted good behaviour on the Internet is explicitly prohibited.
OpiJob does not guarantee the privacy and security of the page, and takes no responsibility for the contributions of third parties that it has not authorized nor for the appearance of virus or similar phenomena in your system or IT equipment.

 

5.4 Service provided by third parties.
OpiJob does not guarantee the truthfulness, precision, privacy, updates, security, availability and/or continuity of the contents and/or services from third parties that are displayed directly on its page or those that are accessed through links, banners, buttons, etc.
OpiJob is not a point of sale for services, but only and exclusively offers an information service as it appears on the Page. OpiJob will not be a party to said contracts and will not be responsible for the quality, content or availability of the services that are desired or that have been contracted.

 

5.5 Opinions, etc.
In addition, the user will refrain from carrying out through OpiJob any behaviour that infringes on the intellectual or industrial property rights of OpiJob or of third parties or that violates or damages the honour, the personal or family privacy or the image of third parties, thus rendering OpiJob immune from legal or extra-legal suits which may be filed against it as a result of said conduct.
The "users" may emit opinions, positive or negative, about the companies or workplaces. OpiJob will not publish comments or opinions that openly infringe upon the honour or the personal or family privacy of third parties. OpiJob is not responsible for, nor does it guarantee, the truthfulness and exactitude of the opinions that may be posted by its users on its Page.

 

5.6 Various
The user promises not to make use of the contents and services provided by OpiJob to carry out or suggest activities that are prohibited morally or legally, and explicitly accepts that OpiJob will be exempt from any responsibility related to the quality, exactitude, reliability, correctness or morality of the data, programs, information or opinions, whatever their origin, that are included on the web Page.

The content, software, images, sounds, text and photographs belonging to OpiJob and other third parties that are included on the web Page are protected by the Royal Legislative Decree 1/1996 of the Intellectual Property Law. The content that is subject to special protection, according to Article 12 of the aforementioned Royal Decree, such as data collection. It is strictly prohibited to reproduce, distribute, publish or transform said property without the express written permission of OpiJob. Unauthorized use of this intellectual property by third parties will result in the legally established sanctions, be they criminal, civil or other. OpiJob takes no responsibility for the infractions of the users of the page that may affect the rights of third parties.


6. Links.
The establishment of a link with OpiJob does not imply acceptance or any type of relationship between the page that establishes it and OpiJob. OpiJob authorizes the establishment of links to the Page as long as the following conditions are met:
- inform us via e-mail (info@opijob.com or through the contact us page)
- inform us of the origin and destination of the link, as well as a description of it
- inform us of the text that describes the link

The link must not declare that it has been authorized by OpiJob, nor shall inexact or false statements about OpiJob, its services or the web Page be made, nor shall links be established from pages that may contain content that is illicit or against moral or public order.

7.Protection of personal data.
OpiJob makes available to users these Terms and Conditions and the Legal Notice so that the user can decide whether to register for any of the databases included on OpiJob’s pages.
The users’ personal data, should they decide to register for the corresponding database, will be used, among other things, for statistical purposes, for the redefinition of the services offered by the page, for the maintenance and management of the relationship with the user, as well as for the purposes of information, training, and/or to send technical, operational and commercial information about the products and services related to the page.

OpiJob will in no case rent or sell personal information to any third party, with the exception of its partners. OpiJob will also have the option of generating overall information about its users and providing this overall information to third parties, including advertisers, for the purposes of marketing and promotion. However, in such a case, this information would not be provided in such a way as to allow third parties to personally identify users.


8.Termination.
OpiJob may interrupt or cancel the Site or any of its services offered to users at any time and without prior notice. In any case, the Company may interrupt the service of any user who makes unethical, offensive, illegal or incorrect use of the content or services of OpiJob and/or uses that contravene the interests of this Company.

9.Force Majeure.
Any event or circumstance beyond the control of the parties or any other unforeseeable contingency, or if foreseeable, any inevitable contingency according to the stipulations and legal precedent of article 1.105 of the Spanish Civil Code will be considered Force Majeure. If for reasons of Force Majeure the service that is the object of this contract is interrupted, said obligation will be suspended to the degree and for the time justifiable.

10.Google Analytics privacy notice.
This web page uses Google Analytics, an analytical web service provided by Google, Inc., a company from Delaware whose main office is at 1600 Amphitheatre Parkway, Mountain View (California), CA 94043, USA (Google). Google Analytics uses “cookies,” which are text file located in your computer, to help the website to analyse the use that the users make of the website. The information generated by the cookie about your use of the website (including your IP address) will be directly transmitted and filed by Google on its servers in the United States. Google will use this information for its own purposes in order to follow your use of the website, compiling reports on the website’s activity and providing other services related to the website’s activity and the use of the Internet. Google may transmit said information to others if so required by law or when others process the information for Google. Google will not associate your IP address with any other information that it possesses. You can reject the treatment of data or information by rejecting the use of cookies through the selection of the appropriate configuration on your browser, but you should be aware that in such a case you may not be able to make use of all of the functions of this website. By using this website, you are giving consent to the treatment of information about yourself by Google in the way and for the purposes outlined above.

11.Third party advertising.
This site may also host advertising for itself, for affiliates or from advertising networks. This advertising is displayed through advertising servers which also use cookies to show advertising content designed for the user. Each of these advertising servers has its own privacy policy, which may be consulted on their web pages.

12.Law and Jurisdiction.
The parties, renouncing individual jurisdiction, if possible, submit to the Courts of Barcelona (Spain). The applicable law will be Spanish law.
